GGYC send the Societe Nautique de Geneve warning of the defending club's 'breach of fiducary duty'

It has been a while in coming - some have argued that this should have been the GGYC/BMW Oracle Racing line from the outset - but last night the Golden Gate YC published a letter they have sent to the Swiss defenders of the 33rd America's Cup, the Societe Nautique de Geneve, warning them that they are considering filing a complaint with the New York Supreme Court over the defending club's "breach of fiducary duty over the last five years".

The GGYC warns that the Trusteeship of the America's Cup (read Paul Cayard's explanation of what this means here) lies with the SNG and not with ACM or Ernesto Bertarelli, although one wonders what might be the case if BMW Oracle Racing were in this position with their club, the GGYC.

The GGYC claim they are considering this due to the SNG/Alinghi's choice of the RAK venue chosen for the 33rd America's Cup.

The letter directly counters the evidence laid out in the papers Alinghi/SNG have filed with the New York Supreme Court earlier this week (read about this here). It includes a number of web links showing RAK's links with international terrorism, including RAK being the birthplace of one of the September 11th suicide hi-jackers, Marwan al-Shehhi.
